Thylib Terms of Service

The Thylib service (the "service") is operated by Perceptive One LLC ("Thylib", "we", "us", "our"). These Terms are an agreement between you and Perceptive One LLC.

1. Eligibility

The Thylib service is offered only to natural persons aged 18 or older who are residents of the United States. By using the service you represent that you meet these requirements.

2. The service

Thylib is a personal health-records platform. We help you import, organize, and explore your own medical records — conditions, lab results, vitals, medications, allergies, immunizations, procedures, reports, and visit history — from healthcare providers you connect (e.g. via Epic MyChart or other SMART-on-FHIR patient portals), and to query those records through the interfaces described in §7.

Thylib is not a healthcare provider, is not a clinical diagnostic service, and does not provide medical advice. Records shown in Thylib are copies synced from your providers and may be incomplete or out of date; your provider's chart remains the authoritative record. Nothing returned by the service should be acted on without consultation with a qualified healthcare provider.

3. Accounts and family access

You access Thylib by signing in with Google. One Google account = one Thylib user. A user may belong to one or more families, the unit of data ownership inside Thylib. Each family is operated by its creator (the founding account); inviting additional family members is not currently available.

The creator may connect records for: themselves; their minor children (as parent or legal guardian); adults they hold formal legal authority for (for example, a healthcare power of attorney or guardianship); and adults who granted them proxy access at their healthcare provider. When connecting a person, the creator attests which of these applies, and the attestation is logged.

Records of an adult connected under provider proxy access are visible only to the creator in the Thylib dashboard and cannot be queried through an AI assistant (§7) until that person confirms consent themselves. We will offer that confirmation step to them by email; until they confirm, AI access to their records stays off.

4. Free trial; subscription; automatic renewal

Use of Thylib beyond the marketing pages requires an active free trial or subscription on your family. Please read this section carefully — a paid subscription renews automatically (the free trial does not).

  • Free trial. Each family receives one 14-day free trial of the full product, which begins when the family's first patient portal is connected. No payment method is collected for the trial. When the trial ends, access pauses; you are not charged and there is no automatic conversion to a paid subscription — continuing requires you to complete checkout yourself. Records synced during the trial are retained for 30 days after it ends, then permanently deleted (see the Privacy Policy), unless you subscribe or delete them sooner.
  • Price. The annual rate shown at checkout (plus applicable tax), billed via Stripe. One subscription covers the whole family; the family admin pays and viewers do not pay separately. Promotional or discounted rates may be granted at our discretion.
  • Term and renewal. The term is 1 year, billed in advance. Your subscription renews automatically each year on or about the anniversary of your purchase, and your payment method on file is charged the then-current rate, until you cancel.
  • Consent. At checkout you are shown these renewal terms and must affirmatively agree to them (a separate checkbox) before payment. We retain a record of your consent.
  • Renewal reminders. We email the family admin twice before each renewal — approximately 40 days and again approximately 15 days before — with the renewal date, the amount to be charged, and a one-click cancellation link.
  • How to cancel. Online, in one click, at any time: Billing → Cancel subscription, or the cancellation link in any billing email. Cancelling turns off auto-renewal; you keep access until the end of the paid year and are not charged again. No phone call is required.
  • Refunds. You can cancel at any time for a prorated refund of the unused part of your paid year (or simply turn off auto-renewal and keep access through the end of the term). The free trial gives you a full evaluation period before any charge exists. See the Refund Policy for details, including price-increase rights for New York residents.
  • Price changes. We will email you before any price increase takes effect, including your next renewal date and the new amount.
  • Lapse. If your free trial expires or your subscription ends and is not renewed, your imported health-record data is retained for 30 days and then permanently deleted, as described in the Privacy Policy. We email you before that deletion happens.

5. Acceptable use

You agree not to:

  • Connect or view another person's records without legal authority or their informed permission.
  • Share your account credentials.
  • Attempt to access data belonging to other Thylib users or families.
  • Use Thylib to deliver clinical services to third parties; Thylib is a consumer tool, not a medical device or an EHR for practices.
  • Reverse-engineer, scrape, or attempt to circumvent our security measures.

6. Your data; our role

Your health records remain yours. Thylib processes them on your behalf to provide the features described in the Privacy Policy. Thylib is a consumer service acting at your direction: we are not a HIPAA covered entity or business associate of your providers, and your use of Thylib is not part of your providers' HIPAA-covered treatment relationship with you. Some state laws nonetheless hold us to healthcare-grade confidentiality duties — for example, under California's Confidentiality of Medical Information Act (Civ. Code §56.06), Thylib is deemed a "provider of health care" for the purpose of keeping your medical information confidential. The consumer health-data protections that apply to Thylib are described in the Privacy Policy.

7. Third-party AI / LLM tool integration

Thylib's core feature is its Model Context Protocol (MCP) integration, which lets you query your own records from the third-party AI assistant you connect — such as Claude, ChatGPT, or Gemini. When you use it, your data leaves the Thylib servers and is sent to the AI provider you have connected. Records are sent only to the provider whose assistant you choose to connect, and only in response to queries you run. The data flow is described in detail in the AI/LLM Disclosure, which is presented for your acceptance as its own document at sign-up.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THYLIB MAKES NO WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND NO WARRANTY THAT RECORDS SYNCED FROM YOUR PROVIDERS ARE COMPLETE, CURRENT, OR ERROR-FREE. NOTHING RETURNED BY THE SERVICE IS A DIAGNOSIS, PROGNOSIS, OR PRESCRIPTION.

9. Limitation of liability

To the maximum extent permitted by law, Thylib's aggregate liability is limited to the greater of (a) USD 100 or (b) the fees you paid Thylib in the twelve months preceding the event giving rise to the claim. Nothing in this section limits our obligation to issue refunds under the Refund Policy, or any liability that applicable law does not permit to be limited.

New Jersey residents: the disclaimers in §8 and the limitations in this §9 apply to you only to the extent New Jersey law permits; they are not intended to, and do not, exclude or limit liability that cannot be excluded or limited under New Jersey law (including liability for gross negligence or willful misconduct).

10. Governing law; where disputes are resolved

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. This choice of law does not take away protections you have under the consumer-protection or health-data laws of the state where you live, to the extent those laws apply to you and say they cannot be waived.

Disputes arising out of these Terms or the service will be resolved in the state or federal courts located in California, and you and Thylib each consent to their jurisdiction — except that (a) you may instead bring an individual action in small-claims court in the county where you live, and (b) where the law of your state of residence gives you a non-waivable right to bring an action in the courts of that state, you may do so. Before filing any claim, you agree to first email us a description of the dispute (§14) and give us 30 days to try to resolve it with you informally.

11. Changes to these Terms

We may update these Terms. Material changes will be presented for your re-acceptance on next sign-in and announced by email at least 14 days before they take effect. Non-material changes (typo fixes, restructuring without substantive change) will be announced by email and reflected in the version string above; continued use of the service after the effective date constitutes acceptance of non-material updates.

12. Termination

You may terminate at any time by cancelling your subscription (§4) and/or deleting your account. We may terminate or suspend access for material violation of these Terms, with notice where reasonable. Data retention and destruction on termination are governed by the Privacy Policy.

13. License; your content; feedback

  • Our license to you. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal, non-commercial use, subject to these Terms. The service, including its software, design, and content (excluding your records), is owned by Thylib or its licensors.
  • Your records; your license to us. Your health records remain yours (§6). So that the service can function, you grant Thylib a limited, non-exclusive license to host, copy, process, transmit, and display the records and other content you import or provide, solely to provide and secure the service and as directed by you (for example, an MCP query you run). This license ends when your data is destroyed as described in the Privacy Policy.
  • Feedback. If you send us suggestions or feedback, we may use it without restriction or obligation to you. Feedback never gives us any right to your health records.

14. Notices

We send notices — including billing and legal notices — to the email address on your Google account, and they are deemed given when sent to that address; please keep it current and monitored. You can send notices to us at legal@thylib.com.

15. General terms

  • Entire agreement. These Terms, the Privacy Policy, the Refund Policy, and the AI/LLM Disclosure are the entire agreement between you and Perceptive One LLC about the service, and supersede prior discussions.
  • Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions remain in full force.
  • No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate — with notice to you and without reducing your rights under them or under the Privacy Policy.
  • Survival. Sections that by their nature should survive termination (including §§6, 8, 9, 10, 13, and 15) survive it.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control (including outages of your provider's patient-access interface) — except for your payment obligations and our data-protection obligations.
